Whistleblower case of fired San Bernardino County social worker can go to trial, appeals court rules 9th U.S.


A federal appeals court has reversed the dismissal of a lawsuit filed by a former San Bernardino County social worker alleging he was fired for reporting a systemic flaw that allowed children to be repeatedly placed into a foster home where sexual abuse was reported.

The Dec. 30 ruling by the 9th Circuit Court of Appeals paves the way for trial on Eric Bahr’s claims that the county and its Department of Children and Family Services wrongfully terminated him in retaliation for his whistleblower actions. The suit originally was dismissed in May 2018 by U.S. District Court Judge Jesus Bernal.
